AbstractAsweknown,negativeconfirmationsuitisakindofindependentlawsuitincontinentallawsystem.Mostcountriesandregionsofthecivillaw,suchasGermany,JapanandTaiwanareaofourcountrystipulatethenegativeconfirmationsuitanditsobject.Fortheinsufficienttheoreticalstudiesonnegativeconfirmationsuitresearch,thereisnoclearstipulationofnegativeconfirmationsuitintheprovisionsofthecivilprocedurelawandonlybeinvolvedinthejudicialinterpretationofourcountry.Inthiscontext,thereisnoin-depthstudyonconfirmationobject.Onlyfewprovisionscanbefoundinjudicialinterpretationswhicharelackofoperability.Therefore,improvingthesystem,andefficientlytakingtheuseofthefunctionofthesystemisextremelypressing.So,thepurposeofthispaperistoexplorewaystoimprovethesystemofnegativeconfirmationsuitthroughmeticulousresearchonthespecificconfirmationobject.Thisarticleisdividedintofourparts;thebasiccontentisasfollows:Thefistpartintroducesthebasictheoryofnegativeconfirmationsuit.Ontheonehand,inordertohaveadeepunderstandingofit,thispartteasesthevenationofitshistoricalbackgroundanddevelopmentandarrangesandcomparesthetheoreticalreferencesofthetheory.Onanotherhand,italsodiscussestheconfirmationobjecttodiscovertheunderlyingconceptsofconfirmationobject,andanalyzetherelatedconceptssuchas“thesubjectmatterofanaction”and“theobjectoflitigation”.Inthelatterpartofthischapter,Idissecttheexistingtheorytolayatheoreticalfoundationforthenextphaseofanalysis.Thesecondpartintroducesthetraditionaltheoryanditsdevelopmentofthespecificconfirmationobject.ThispartattemptstosystematizethetheoreticalandpracticalachievementsofconfirmationobjectinGermany,JapanandTaiwanarea,withcomparisonmethodofanalysis.Thenegativeconfirmationsuits’objecttraditionallyshouldbe“thelegalrelationshipisnotexisting”,asanexception,theauthenticityofinstrumentscanbetheobjectofthenegativeconfirmationsuit.Tomeettherequirementofjudicialpractice,inrecentyears,Taiwanarea’scivilprocedurallawincorporated“thebasicfactsoflegalrelationshipisnotexist”intothescopeofnegativeconfirmationobject
