摘要“服务型政府”概念在我国地方政府和学术界于本世纪初提出。在新时期依 法治国的大背景下，服务型政府的宗旨就是在法律框架内提供令公众满意的公共 服务，服务型政府建设必须走法治化之路。民族地区因其特殊的区情、民情，进 行服务型政府建设必须在法律框架内因地制宜。由于民族地区经济发展不平衡、 受传统观念束缚，加上地域、人情、风俗等综合因素的限制，对服务型政府建设 进行法治化路径研究有着重要的理论与实际意义。本文以恩施土家族苗族自治州建始县为例，对民族地区服务型政府建设法治 化的现状进行了分析，对存在的问题进行了总结，深层次挖掘其在发展过程中的 障碍性因素，对其法治化路径进行了探讨。本文分为四大部分：第一部分对服务型政府的内涵和特征做基本的介绍，并对服务型政府和法治 化之间的关系进行理论阐述：法治政府是服务型政府的题中之义，服务型政府具 有法治化的必然性。第二部分对建始县在进行服务型政府法治化路径探索过程中的实践经验进 行总结。这部分主要通过实地调研，对搜集的资料进行整理归纳，具体归纳出作 为一个欠发达的少数民族建始县在构建服务型政府的法治化路径主要是：转变观 念、精简机构，优化决策、促进科学民主， 简化程序、提高服务效率，完善 职责职能，建立 、发 展社会保障， 强 化监 督、健全工作机 制， 建立行政 首 长出庭应诉制度，强化行政责任。第三部分主要是挖掘当前建始县进行服务型政府法治化路径中依然存在的 一些阻碍因素及原因，例如：观念变革迟缓；政府管理中的“错位”、“越位”、 “缺位”现象依然存在；政府行政人员服务的能力和水平不高；政府绩效评估机 制不完善；公共服务形式单一，社会参与程度低；制度的长效性建设不足等。第四部分针对上述问题，尝试性地探索在民族地区进行服务型政府法治化路 径研究应该从何着手？首先应从观念改革入手，加强服务型行政文化建设，树立 透明公开的行政理念，确立以服务为核心的行政价值取向。其次应进行制度的长 效性改进。为此应转变传统管制型政府职能，精简机构与人员，联合办公，加强 部门之间的合作沟通；提高公务员能力与素质，推进政府绩效评估法制化建设； 推行公共服务市场化和社会化，引入民众参与治理。第三是完善服务型政府建设的监督机制，加强地方权力机关监督，强化社会公众监督，健全信访举报制度，完善司法回应制度，矫正服务型政府在法治化之路中的歧途。关键词：服务型政府；法治化；民族地区；建始县；司法回应制度AbstractThe concept of service-oriented government has been put forword in Chinas local government and academic at the beginning of this century. In the new era under the background of the rule of law, the purpose of the service-oriented government is to provide the public satisfaction within the legal framework of the public services, service-oriented government construction must take the path of the rule of law. Ethnic minority areas construct a service-oriented government must be within the legal framework to adjust measures to local conditions because of its special situation, mood. Due to the unbalanced economic development in national regions, the restriction of traditional concept, combined with geographical, human feelings, the limitation of comprehensive factors such as customs, carried out on the construction of service-oriented government under the rule of law path research has important theoretical and practical significance.This article takes JianShiXian
