摘要湿地处于陆地生态系统(如森林和草地)和水生生态系统(如深水湖和海洋)的过渡地带，形成了一个不同于陆地和水域的独特生态系统。湿地具有陆地与水域系统不可替代的生态功能，它广泛分布于世界各地，具有极高的经济价值、生态价值和社会价值。我国湿地面积约占世界湿地的10%，位居亚洲第一位、世界第四位，是名副其实的湿地资源大国。然而长期以来，我国对湿地保护不够重视，湿地保护中存在着许多问题。立法方面缺乏专门的湿地立法，同时现行关于湿地保护的法条过于分散，缺乏协调，甚至存在一些不利于湿地保护的法律规定。实践中不合理的开发利用导致了天然湿地的锐减，景观严重丧失，湿地环境质量下降。同时资源利用过度，使生物多样性受损，湿地功能日益下降。我国自1992年加入《关于特别是作为水禽栖息地的国际重要湿地公约》(简称《湿地公约》)之后，湿地资源保护和利用在中国是一个需要研究的新课题。通过立法，以法律、法规形式调整湿地资源开发、利用、保护和管理，是解决湿地保护和合理利用问题的一个根本途径。但是一直以来我国湿地资源立法的研究开展甚少，到目前为止我国还没有一部在国家层面专门规定湿地保护的法律法规。2010年，中国民主促进会中央委员会在全国政协十一届三次会议上提交提案，建议尽快制定并颁布《湿地保护条例》。本文从中国湿地保护现状出发，揭示中国湿地资源存在的危机，并借鉴己有的国内外研究成果，分别从立法目的、立法原则、立法的调整范围、法律的位阶选择、立法模式、法律制度完善几个方面论述了中国湿地资源保护与立法中所涉及的一系列立法问题，旨在为我国建立和完善湿地保护专门法律提供有益探索和建议。本文在法律制度的构建和安排上有所创新。本文分别从湿地规划制度、湿地生态系统监测制度、湿地资源权属制度、环境影响评价制度、湿地开发利用许可制度、湿地生态补偿制度、自然保护区制度、湿地保护公众参与制度八个方面来进行构建，从而对湿地生态系统功能进行有效保护。关键字：湿地；保护；法律制度AbstractWetlandisinthetransitionzoneofterrestrialecosystem(suchasforestandgrassland)andaquaticecosystem(suchasdeeplakesandocean);duetothat,theuniqueecosystem,whichisdifferentfromterrestrialandaquaticecosystems,hasbeenformed.Thewetlandiswidelydistributedallovertheworldandithasthegreathighestvalueeconomics,ecologyandsociety;exceptthattheecologicalfunctionsofwetlandwhichcannotbereplacedbytheterrestrialandaquaticecosystems.TheareaofwetlandinChinahasreached10%oftheareaofwetlandontheworld,whichisthetopofAsiaandfourthplaceontheworld;thereforeChinaisareallyhugecountryofthewetlandresource.TheprotectionofwetlandisnotvaluedforalongtimeinChinaandtherearemanyproblemsintheprotectionofwetland.InChina,thereisnotaspeciallawfortheprotectionofwetland,inthesametimesomeprovisionsoftheprotectionofwetlandaretoodispersiveanditisverydifficulttocoordinatethoseprovisions;even,therearesomeprovisionsareunfavorabletotheprotectionofwetland.Infact,theunreasonabledevelopmentofthewetlandcausesthesharpcutoffofthenaturalwetland,thelossofwetlandlandscape,andthedeclineoftheenvironmentalqualityofwetland.Meanwhile,theexcessiveuseofthenatureresourcetakesthedamageofthebiodiversityandthedeclineoffunct
