摘要摘要近年来，包括“苏丹红”“三聚氰胺”在内的各种食品安全问题成为了社会关注的热点，食品安全问题作为人类生存的基本问题，关系到国家生存和发展。我国食品安全法经历了4稿修订之后，于2009年6月1日生效实施，标志着我国食品安全领域系统性立法的开始。值得注意的是新颁布的《食品安全法》在总则之后，将“食品安全风险监测与评估”列为第二章的内容，足见该制度的重要性。食品安全风险监测和评估是制定、修订食品安全标准和进行食品安全实施监督管理的科学依据，在食品安全问题的监管环节中占据了非常重要的地位。我国对于该制度的认识起步较晚，受到经济水平、立法技术落后等现实国情因素的影响，尚未建立起完善的食品安全风险监测和评估制度。本文采用规范分析法、比较分析法，对我国食品安全风险监测与评估制度的现状与发展进行梳理，并结合各国食品安全风险监测与评估制度的构建模式及其经验，探讨其借鉴意义，并结合我国国情从完善运行机制和法律规制两个方面提出了完善食品安全风险监测与评估制度的建议，其中运行机制方面主要包括理清中央与地方食品风险监测部门之间的职权分工关系，进一步加强食品安全风险评估部门的独立性，加大投入提高食品安全风险监测与评估机构的分析水平，鼓励企业参与食品安全风险分析，重视消费者组织等社会团体的作用，进一步完善食品风险监测与评估的相关机制，法律规制方面包括制定和完善专门的食品安全风险监测与评估的法律规定，食品安全法律之间的协调与完善，积极参与国际食品安全风险监测和评估的法规建立工作等。关键词食品安全风险监测评估完善AbstractAbstractInrecentyears,variouskindsoffoodsafetyproblemsincluding“Sudanred”and“melamine”becomethehotspotsofthesociety.Asafundamentalproblemofhumansurvival,thefoodsafetyissueiscrucialtoanationssurvivalanddevelopment.After4thdraft,theFoodSafetylawofthePeople’sRepublicofChinawasofficiallyimplementedon1st,June,2009,whichsymbolthebeginningofthesystematiclegislationinthefieldoffoodsafetyinChina.ItisnotablethatinthenewlyenactedFoodSafetyLaw,thecontentofSurveillanceandAssessmentofFoodSafetyRisksisputasthesecondchapternearafterthegeneralprinciples.Therefore,thesignificanceoftheSurveillanceandAssessmentofFoodSafetyRisksshouldnotbeneglected.SurveillanceandAssessmentofFoodSafetyRisksisthesignificantscientificbasisforenactingandrevisionofthefoodsafetystandards.Inthefieldofsupervisionandadministrationoffoodsafety,itoccupiesasignificantposition.ThisSurveillanceandAssessmentofFoodSafetyRiskssystemhasbeenrecognizedinChinacomparativelylatetoothercountries.Ithasnotbeencompletelyestablishedforeconomic,legislativeandotherdomesticfactorsatpresent.ThispaperintroducesthecurrentsituationandthedevelopmentoftheSurveillanceandAssessmentofFoodSafetyRiskssystem,usingnormativeanalysisandcomparativeanalysis,Exploresthemeaningofthequotationofworldwideconstructingmodeandexperienceofthissystem,andproposetheimprovementsuggestionwhichissuitabletothedomesti
