摘 要随着电子商务的发展，域名商业价值日益凸显，因此也就引发了域名抢注等域 名与其他商业标志的纠纷，学者们更是纷纷对域名的法律性质进行了研究，但得出 的结论并不统一。本文在国内学者们对域名的法律性质研究成果的基础上， 对域名 进行了试探性定性，提出了自己的一些观点和建议，希望对解决此类纠纷并对域名 进行相应的保护有所帮助。论文主要分为两部分。第一部分对域名及的法律性质进行了较为细致深入的研 究，并明确界定了域名权的内涵和内容。通过分析认为在实然状态下域名由于不具 备知识产权的法定性，还不是知识产权，但是应然状态下，应当将域名归入知识产 权的一种客体，这也是比较适当的。同时，本文进一步分析，认为可以把域名中具 有显著性的一部分定性为知识产权子集合商业标志的一种，这样既对这部分域名进 行了准确细致的法律定性，也为后面解决这部分域名与其他商业标志的纠纷奠定了 基础，有助于对域名的保护。第二部分是对域名的法律保护进行了研究。首先研究 侵犯域名的三类纠纷类型，其中以反向域名侵夺型纠纷最为典型。此后通过对国内 外域名保护现状的研究，结合我国现阶段域名保护的不足之处，提出了完善我国域 名保护制度的一些建议，这些建议又可分为预防性的和解决纠纷性的。关键词：域名；法律性质；保护；完善IAbstractWith the development of e-commerce,domain name ’s commercial value has become increasingly prominent,which lead to cybersquatting disputes between domain names and other commercial signs and so on. Scholars one after another have researched the legal nature of the domain name , but conclusions are not uniform.In this paper,author try to define the legal nature of the domain name on the basis of domestic scholars,put forward some ideas and proposals of my own ,hoping to benefit for resolving such disputes,and provide legal protection for domain name.The paper is divided into two parts. The first part make a deeper research about the legal nature of domain name ,also clearly define the meaning and content of the domain name right. By analyzing the nature ,we come to the conclusion that: In the actual status ,domain name without the legality of intellectual property is not an intellectual property, but the domain name should be classified as an object of intellectual property, which is also appropriate. Meanwhile, some significant domain name can be considered to a commercial signs which is a subset of Intellectual Property.This accurate and detailed qualitative analysis does not only lay a foundation for the settlement of disputes between domain name and other commercial signs,but also provide a basis for the protection of the domain name. The second part of the paper studied that how to protect the domain name in legal. Fir
