服务外包若干法律问题研究 （硕士论文摘要） 当前，许多跨国公司出于降低成本、增强竞争力的考虑，正在向中国转移相关服务产业，中国服务外包作为发展外向型经济的支持面临良好的发展机遇。面对这一大好形势，中国商务部规划了中国服务外包的发展前景。根据规划，在十一五2006-2010年规划期间，中国将在全国建成10个具有一定国际竞争力的服务外包基地城市，推动100家世界著名跨国公司将其一定规模的服务外包业务转移到中国，培育1000家取得国际资质的大中型服务外包企业，实现2010年服务外包出口额在2005年的基础上翻两番。 在这一机遇与准备不断对接的情况下，中国2008年发展服务外包的形势也相对较好。根据商务部提供的相关统计显示，2007年，中国服务外包出口合同执行金额20.94亿美元，比2005年增长118%。WTO成员方之间流动的过程中将会受到市场进入方面怎样的限制？服务外包的过程实质上就是数据的外包过程，因此，服务外包合同的核心就是知识产权的许可合同，则，在对合同中的知识产权滥用如何进行规制？在服务外包合同的履行中发生纠纷后，在寻求司法救济进行，管辖法院是否可以基于一般的商事合同来进行确认？这些问题本文将进行系统研究。 [关键词] 服务外包 市场准入 知识产权滥用 回授 管辖权 Research on Several Legal Issues Related to Service Outsourcing (Abstract) Major: International Law Study Direction: International Economical Law Author: Xu Wenjin Instructor: Prof. Ding Wei At present, with regard to reducing costs and enhancing competitiveness, many multinational companies are transferring their related services industry to China. Therefore, Chinas service outsourcing, as the support of the development of export-oriented economy, is facing a good opportunity for development. Facing with such an excellent situation, Chinese Ministry of Commerce figured out a development prospect of Chinas service outsourcing. According to the plan, during the Eleventh Five-Year (2006-2010) period, China will build 10 service outsourcing base cities with some of the international competitiveness, promote 100 world famous transnational corporations to transfer a certain level of service outsourcing to China, cultivate 1000 large and medium-sized international qualified service outsourcing enterprises, and quadruple the service outsourcing export volume of the year 2005 by 2010. In the case of opportunity continually interfacing with the preparation, China’s development of service outsourcing in 2008 is relatively under a better situation.
