论无主物的归属——先占制度在我国的适用摘要 先占，作为一种原始的所有权的取得方式，最早可以追溯到古罗马时代，其也被称为“先占取得”，是指自己所有的意思，表示先于他人而占有原属无主的动产。先占制度也是自罗马法以来世界各国法律大多数都予以承认的制度。目前，我国的物权法中并未对先占制度有规定，但是在司法实践中，对于例如拾荒、在江河中垂钓等先占是予以默认的。由于缺乏相关的制度规约，因而我国现在存在众多关于无主物归属而引起的纠纷。本文就无主物的概念、渊源及特征进行了阐述，也基于各国的先占制度对我国先占制度进行了探索，并对我国无主物归属权的规定和缺陷结合我国法律提出了相应的对策和建议。关键词: 无主物，所有权，先占制度Application of Attribution Theory of Ownerless Things -- Preemption System In ChinaAbstract Preemption as a primitive ownership acquisition mode, originated in ancient Rome era, also known as preemption, which has belongs to own everything, chattel possession was said before others without the lord.
