河北 河北经贸大学硕士毕业论文 II II Abst r act GMOs is the development of high-tech and entails some superiorities which many non-GMOs does not have. But on the other hand, genetic technology is not mature and the quality security of the product is still uncertain, and it may arise some risks of the health of human being, Biology and environment, so many countries all over the world take different measures based on different Understanding on GMOs. The uncertain danger of GMOs has caused the intense conflict between the main importing and exporting countries and has produced the influence on the international trade. The aim of this article is to seek the solution of the conflict through analyzing causes of the conflict and relative rules of the trade. In 2001,China has been admitted to World Trade Organization as a member. Simultaneously our country also has the suitable trade benefit on the GMOs, and inevitably being involved in trade conflict, so this article may be helpful for our country’s legislation. At first, the article discusses whether GMOs trade belongs to the SPS agreement jurisdiction of WTO. Secondly, the article analyzes the principles of the SPS which GMOs trade should follow. At last, the article has a research on the foreign policies and rules on GMOs, analyzes the present law and stipulation of China on the GMOs in detail, and puts forward some proposals for strengthening our legislation on GMOs.
