摘要 摘要 万方数据 万方数据 摘 要 本文从分析我国“过劳死”的救济案例出发,在剖析一般观点的基础上,提 出法律意义上的“过劳死”,从而对我国由于用人单位违法加班造成的“过劳死” 进行探究。接着综合学界的研究以及我国法律体系，提出将“过劳死”作为一 种新的工伤情形纳入工伤保险，并对其工伤保险制度与预防制度作进一步的探 究。第一章引言简述“过劳死”现象在我国日益恶化,建立有效的法律保障制度 势在必行。第二章分析近些年我国比较典型的案例,指出我国“过劳死”存在的 法律问题以及对“过劳死”基本问题的概述。第三章对我国“过劳死”的社会 现状与法律现状进行综合分析，并借鉴其他国家和地区的经验，寻求对我国“过 劳死”保障的启示。第四章指出我国应当将“过劳死”纳入工伤保险，并分析 其必要性和可行性。第五章从立法明确“过劳死”的认定标准，认定的程序， 补偿和赔偿机制三个大方面论述建立我国“过劳死”工伤保险保障体系的构想。 第六章从强化劳动监察制度，加大处罚力度、提高职工自我保护保健意识和鼓 励民间团体参与“过劳死”预防四方面建立“过劳死”预防制度。最后是结论 和对“过劳死”的展望。 关键词: 过劳死；工伤保险；认定标准；预防制度 II Abst Abstract ABSTRACT This paper begins with the analysis of Karoshi relief cases, points out Karoshi in the legal sense based on the analysis of the general view, and explores the Karoshi because of illegal overtime caused by the employer in our country . Then comprehensive academic research and our legal system, proposes that Karoshi as a new injury situation into work-related injury insurance, and further explores its work-related injury insurance system and prevention system. Chapter one introduction descriptions Karoshi worsening phenomenon in our country, it is necessary to establish an effective legal protection system. The second chapter analyzes typical cases of recent years, points out Karoshi legal problems in our country and summarizes Karoshi fundamental issues. The third chapter analysis of Karoshi social and legal status and learn from the experience of other countries and regions, seeking enlightenment to the Karoshi security. The fourth chapter points out karoshi should be into the work-related injury insurance and analyzes the necessity and feasibility. The fifth chapter from three major aspects of clearing standard of Karoshi, certification process, compensation and reparation mechanisms to establish the Karoshi work-related injury insurance system in China. The sixth chapter of establish the Karoshi preventive system from strengthening labor inspection system, increase penalties and raise awareness of health protection of workers an
