摘要本文是一篇针对法律英语文本中条件句的翻译报告。条件句是法律文本中的常用句法，也是法学文献中的常用句。译者在翻译过程中发现，《中国刑法评注》一书中出现了大量由 where, if, when 等引导词引导的条件句。由于条件句是法律英语文本中的重要组成部分，因此译者有必要系统且有效地探讨条件句的翻译策略。英汉句法结构存在差异，即英语重形合，主谓宾完整，而汉语重意合，多无主句。法律英语条件句多用显性表达，法律汉语条件句则多用隐性表达。翻译法律英语条件句时，通常将句中的显性条件转换为法律汉语条件句中的隐性条件。本报告根据英汉条件句的异同，主要采用“显性条件转换为隐性条件”和“调整条件从句的位置”这两种翻译策略对《中国刑法评注》中的条件句进行汉译总结，力求达到忠实还原源语言信息的目的。关键词：法律英语；条件句；翻译策略 Abstract Abstract This is a translation report on conditional sentences in legal context. Conditional sentences are common syntaxes in legal texts. During translating the material, the author has found that there are a large number of conditional sentences in Notes and Commentaries on Chinese Criminal Law and Cognate Topics with Special Relation to Ruling Cases (hereinafter referred to “Notes and Commentaries on Chinese Criminal Law”). Since a conditional sentence is an important part of legal documents, the author needs to discuss the translating strategies of conditional sentences correctly and systematically. English sentence building is featured by hypotaxis, while Chinese sentence building is featured by parataxis. To clarify the relations in conditional sentences, English more often resort to overt cohesion, frequently using various cohesive ties. By contrast, Chinese more frequently relies on covert coherence and context, focusing on temporal or logical sequences. When translating the legal English, the author tends to translate an explicit English conditional sentence into an implicit Chinese conditional sentence. According to differences and similarities of English and Chinese legal conditional sentences, this report mainly summarizes and discusses the English-Chinese translation of conditional sentences in Notes and Commentaries on Chinese Criminal Law. To faithfully reduce the source language information, the author has taken different translating strategies.
