摘要 转折词是表示转折关系的连接词，在语篇构造及其连贯关系上起重要作用。 从语言的结构形态上看，英汉两种语言存在差异。换言之，英语主要为综合性语 言，其语篇的连贯方式倾向于语言间的形式手段，以实现句子间的连接；汉语主 要是分析型语言，其语篇的连贯方式主要靠逻辑间的关系连接在一起，较少使用 连接词语。源于普通语言的法律英语语篇和法律汉语语篇构建都要遵守各自的语 言规律，英汉法律语言转折词语的使用也不例外。因此,英汉两种语言法律语言 的翻译在某种程度上体现在连接词的翻译上，其中较重要的是转折词。在英语法 律文献的转折句中，转折词总是以显性或隐性的特点呈现，译者若是不顾英汉语 言的差异，一味地生搬硬套，难免出现译文过分欧化，甚至错译，有悖于汉语读 者的思维模式及其语言表达习惯。因此，本文认为，在英语法律文献中转折词的 翻译中，应将其中的显性英语转折词和隐性英语转折词分别显化或隐化，在忠实 地表达源语含义的同时，译出符合汉语读者习惯的译文。 关键词：转折词；英译汉；显化；隐化 Abstract Adversative is a conjunction which reflects a relation of transition. It plays a significant role in discourse structure and cohesion. One of the differences between English and Chinese in language structure is that English is a synthetic language while Chinese is an analytic one. The former tends to apply conjunctions in sentence cohesion, while the latter tends to rely on the logic relation in sentences, with no or few conjunctions. Because the legal English discourse and legal Chinese discourse are originated from ordinary language, they need to follow rules of each language, and adversative of legal language is no exception. Therefore, English-Chinese translation reflects in the conjunction translation to a certain extent, in which the translation of adversatives is most important. In English legal translation, if we translate adversatives into Chinese directly without any modification, the whole translation will be filled with westernized sentences, or even be mistranslated, and will be understood with difficulty by Chinese readers, because the way of writing is against their modes of thinking. Because of the explicitness and implicitness of adversatives, the author suggests there are four techniques in their translation: implicitation of the explicit adversatives, explicitation of the explicit adversatives, implicitation of the implicit adversatives and explicitation of the implicit adversatives.
