摘 要 《诉讼费用交纳办法》的出台，对当事人的诉权行使和对法院的正常运 转都将产生深远的影响。对法院而言，在《办法》出台以前，已经形成维持 自身运转的做法，在《办法》实施以后，法院是否会沿用先前的运转模式， 如果《办法》的刚性得到张扬，法院应当思索如何在《办法》的制约与当前 的财政保障体制现状下正常运转。《办法》的出台明显降低了当事人的诉讼 费用成本，但以当事人诉权行使的视角而言，除此之外，还有影响当事人选 择是否起诉的其他因素。《办法》体现了系列的理念创新与制度创新，但也 存在内在缺陷和实施困境，我们应当进一步推进司法改革，以确保《办法》 得到有效执行，平衡当事人的诉权行使与法院的正常运转。 关键词：诉讼费用交纳办法；当事人；诉权行使；法院正常运转；平衡 ABSTRACT The introduction of “the rules of paying to the litigation fees” will have a far-reaching effect to a right of appeal to the parties to exercise and the normal operation of the Court.The court, in the measures introduced ago, has been formed to maintain its operating practices in the measures implemented, the courts will continue to use the previous mode of operation, if the measures by the rigid publicity, the court should ponder how to measures with the constraints the current financial status security system under normal operation. measures significantly decreased the introduction of the partys cost of litigation costs, but the exercise of the right of appeal to the parties in terms of perspective, in addition, there are influencing the choice of whether or not to prosecute other factors. measures series embodies the concept of innovation and system innovation, but there are also inherent flaws and implementation difficulties, we should further promote judicial reform to ensure that the measures being implemented effectively, the right of appeal, the parties to exercise balance with the normal operation of the Court.
