1 1 内容摘要 最低工资法律制度，历来是国家基于社会公平价值目标对劳资关系进行调整的一项 重要手段，特别是在目前我国贫富分化严重，社会和谐目标成为重要的社会发展任务的 时候，系统研究这一制度的基本理论，揭示现有制度运行的不足，并提出完善的建议， 具有重大的理论意义和现实意义。 本文综合采用了价值分析法学、比较法学、实证分析法学等多种研究方法，对最低 工资制度的历史演进、理论基础和我国的实行现状逐一进行了分析，并在此基础上提出 相应的完善措施，以期为最低工资制度的发展有所裨益。 本文共分三个部分。第一部主要围绕最低工资制度的概念、特征，最低工资制度的 发展历史，以及最低工资制度的理论基础等方面进行展开，以阐述最低工资制度的基本 理论。通过对概念、特征的介绍，为进一步分析最低工资制度奠定基础；通过对中外最 低工资制度历史演进的考察，揭示最低工资制度产生的历史根源和存在的必然性；通过 对最低工资制度理论的分析，论证最低工资制度的基本价值和意义。第一部分理论基础 的论述，为第二、三部分审视我国最低工资制度的基本问题和提出完善的建议奠定基础。 本文第二部分主要是阐述我国最低工资制度的现状，包括最低工资制度的三个层 面。首先，从最低工资制度的观念层面，分析社会各界关于最低工资制度存废的争论； 其次，从最低工资制度的立法层面，论述我国最低工资制度的立法现状；再次，从最低 工资制度的运行层面，以详实的数据，展现我国最低工资标准与相关因素的差异。 在第一、二部分的基础上，本文的第三个部分对我国最低工资制度现状进行了评述， 评析了我国最低工资制度的主要问题，并提出了相应的完善建议。 关键词：最低工资制度；最低工资标准；最低工资制度完善 1 1 Abstract Legal minimum wage system, the country has always been a goal of the fair value based on social relations between employers and employees as an important means of adjustment, particularly in the current polarization of our serious goal of social harmony and social development become an important task, the systematic research of this systems basic theory, operation revealed the inadequacy of the existing system and put forward a sound proposal, is of great theoretical and practical significance.
