论修改体育法目原则与取向 　　摘 要：在修改《体育法》中坚持法治新十六字方针中“科学立法”要求的一个重要方面，是要对这种意志表达与创造活动进行科学认识与规律考量，对事关修法全局的重点基础问题作出理性思考与理论回答。从建构法律秩序、确立体育地位、彰显人本性与现代性、支撑合法性与有效性等宏观视角，探讨修法应明确的基本目的；基于法制统一与政策协调、现实国情与体育需求、改革前瞻与保持稳定、必要宣示与操作可行等关系因素，提出修法应坚持的主要原则；在对现行《体育法》价值关注和现代法治权利重心予以分析的基础上，明确修法应进行价值重构而确立体育权利保护的根本取向。 　　关 键 词：体育法；修法目的；修法原则；立法取向；中华人民共和国体育法 　　中图分类号：G80-05 文献标志码：A 文章编号：1006-7116（2017）05-0001-09 　　Abstract： An important aspect of the “scientific legislation” requirement in the new 16-character guideline for adhering to government by law in revising Sports Law， is to carry out scientific cognition and pattern consideration on such a will expression and creative activity， and to carry out rational thinking on and give theoretical answers to primary basic questions in relation to the overall situation of law revision. From such macroscopic perspectives as building legal order， establishing sports status， highlighting human nature and modernity， and supporting legitimacy and validity， the authors probed into the basic purposes that should be specified for law revision； based on relation factors such as legal unification and policy coordination， realistic national conditions and sports needs， reform prospecting and stability maintaining， as well as necessary declaration and operation feasibility， the authors put forward the following major principle that should be adhered to for law revision： on the basis of analyzing the value focus of the existing Sports Law and the key rights of modern legal governance， specify that value reconstruction should be carried out for law revision， thus establishing the fundamental orientation of sports right protection. 　　Key words： sports law；law revision purpose；law revision principle；legislation orientation；sports law of the People’s Republic of China 　　在我??全面推进依法治国、法律修改在形成中国特色社会主义法律体系后已经成为立法重心的大背景下，颁行于1995年的《中华人民共和国体育法》（简称《体育法》）不适应现实需要的问题愈益凸显，对其进行修改10多年来受到我国法治建设的热切关注。修改《体育法》，早已列入国务院立法工作计划，国家体育部门也早就启动了基础研究，近来又在加快推动工作进程。按照党的十八大确定的法治新十六字方针中“科学立法”的要求，在修改《体育法》中坚
