ABSTRACT The extraterritorial application of Antimonopoly Act has more than 60 years since America established it in 1945 formally. Now international society has affirmed this system, and more than 50 countries including our country have regulated extraterritorial application in their Antimonopoly Acts. In spite of establishing this system, we lack of laws about how to carry out it. In the case of lacking theory accumulation and practical guidance, we may learn from developed countries optionally. This article mainly introduced the related the extraterritorial application of anti-monopoly law of some basic problem. Including the extraterritorial effect of law is defined, and then introduced the extraterritorial application of anti-monopoly law concepts, and discussed the extraterritorial application of anti-monopoly law theory, including the economic level and the level of international law theory. For the principle of choice, the author described the United States from the effect of the principle of reasonable under the jurisdiction of the principle of development, the EUs three main principles and the limited effect principle of German, and make the evaluation to it. Regarding these questions, the author refers to present international method to provide some suggestions from four aspects, including country restraint itself, two countries collaboration, regional cooperation and build international antimonopoly mechanism. Finally discussed our extraterritorial application of anti-monopoly law, discussed the present situation, and analysis of its defects. Then, in view of our country present situation, this article gived suggestion in principle, choice of legislation, obstruction of legislation, international cooperation, contrasting with foreign extraterritorial application of anti-monopoly law experience and lesson.
