阳新县86起行政处罚的案例分析 　　【摘要】 目的：通过对我县86起行政处罚案例分析，查找存在问题提高依法行政水平。方法：运用了逻辑分析法和描述统计法，对86件行政处罚案卷运用归纳、类比、汇总等逻辑等分析方法从不同行业、处罚案由、处罚类别及罚款金额的幅度进行统计分析。结果：86起受罚案例中餐饮服务业、化妆品和保健食占处罚总数分别为96.51% 、3.49%、0；受罚案例的餐饮服务大型以上、中型、小型餐饮及食堂占餐饮服务处罚总数的比例分别为7.23%、36.15%、49.39%、 7.23%；38.55%违反从业人员健康证管理规定，30.12%违反食品生产经营过程不符合食品安全标准的；简易程序53起，占61.63%，一般程序33起，占38.37%，听证程序0起；处罚案例罚、没款总额为96178元人民币。结论：通过对我县86起行政处罚案例分析，我县目前监督工作中还存在一些问题和不足，还需在队伍建设、监督管理、政府支撑及全员参与等方面加强。 　　【关键词】 阳新县；食品安全；行政处罚；案例分析 　　【Abstract】 Objective： finding out the problems to improve our lawful administration through analyzing the 86 administrative punishment cases in our Jianghan District.Methods：statistic and analyze the 86 administrative punishment cases in aspects of industry type， cause of action， categories of case， fines by Logical analysis and Describe the statistical method.Results：of the total 86 administrative punishment cases， cases of Catering services， Cosmetics industry，health food accounted for 96.51%， 349%， 0% respectively； of the cases of Catering services， cases of large and above， medium， small restaurants and canteens accounted for 723%，.36.15%， 49.39%，723% respectively； of the cases of Catering services， cases of violation of regulations employed health certificate accounted for 38.55%， cases of violation of food production and operation process accounted for 30.12%； 53 cases are summary procedure， take the percentage of 61.63%， and 33 cases are general procedure， represent 38.37%， none of procedure of hearing， the total amount of fines is 96，178 yuan.Conclusion：There are still some problems and shortcomings in our supervision， we also need strengthen our team building， supervision， management， government support and full involvement， through the analysis of the 86 administrative punishment cases in our region. 　　【Key words】 Jianghan District； food safety； administrative penalty； analysis of cases 　　【中图分类号】R55.5 【文献标识码】B 【文章编号】1005-0019（2014）03-0564-01 　　民以食为天，食以安为先，食品安全是关乎民生的最重要基础。通过对我县86起行政处罚案例分析，查找存在问题，以指导改进监督执法工
