This section briefly introduces the historical background of road accident compensation and legislative history, and, the meaning and structure elements about road accident compensation are described. The second chapter is on China traffic accident compensation liability principle. This section first introduces responsible principle of the Two Schools’ countries attributable to road accident compensation, and China’s road accident compensation attributable to the legislative process, and then by analyzing the case, making comments on “Road Traffic Safety Law” Article 76, finally, making a comparative analysis of relevant provisions of home and abroad. The third chapter is on the responsible subject of China road accident compensation. This section first elaborated the title and decided standard of responsible subject, and then followed by a few special cases of road traffic accident liability for damages identification of the responsible subject were analyzed. The fourth chapter is on the road traffic accidents on China’s damages on the scope and compensational standards. This section of road traffic accidents are divided into the scope of damages for personal injury compensation for regular projects, to cause death, disability compensation for items of special personal injury, mental injury and property damage compensation for the project in four parts of the project to be elaborated. Part V is on the analysis of the responsibility of road accident compensation of lack and perfection of relevant legislation.
