万方数据 万方数据 Abstract At present, the number of traffic accidents in China has always been a high status, caused a greater threat to the security of peoples life and property, the treatment of road traffic accidents has become a job with strong connections to people in social life .The identification of road traffic accidents play a bond role in the whole incident handling work. The majority of people are not satisfied with is that the road traffic accident caused a large number of contradictions and disputesin the actual operation process,even caused a number of petition cases. Investigate its reason, in addition to the high amount of road traffic accident operation, the existing road traffic accident identification have some problems,such as responsibility subjective arbitrariness, lack of procedures not rigorous enough, relief channels and so on. Therefore, there is a need from the theory and practice research on road traffic accidents, in order to effectively regulate the administrative power,protect civil rights. To accurately understand road traffic accident, find and solve problems,first of all,we should study on the basic theory of road traffic accident,accurate define road traffic accident related concepts.establish the theory foundation for the research problem.Secondly,in a road traffic accident on the basis of the legal provisions in force,we should carefully study the current road traffic accident identification problems,such as the lack of recognition of the independent status of subject, the work procedure is not precise enough,the division of responsibilities of the standard is not unified, serious lack of relief channels and so on.Lastly,for the above problems,we have to put forward a perfect method one by one.
