Abstract
Based on a detailed longitudinal review of the development of the judicial budget system of
Chinese district courts, this thesis emphasizes on current judicial budget system of China and the
safeguard mechanism of the political and legal budget of Chinese central government. There is a
most serious problem in the safeguard mechanism of judicial fund, i.e. the severe reliance of
expenditures of legal systems including courts of all levels on local public finance. The existence of
this problem violates our unitary constitutional constitute and jurisdiction rules and the process of
solving this problem, together with the co-functioning of the localization of the court’s human
resources management and administration of judicature, promotes and reinforces the localization
of Chinese judicial system. As the security of the judicial budget must be in accordance with the
general operation rule of jurisdiction and the requirement of judicial system as well as the finance
management system, the reform in judicial system requires the localization of jurisdiction and the
finance management system decides that the fund of the judicial system relies heavily on local
public finance. Consequently, the reform of current judicial funding system is inevitable. The reform
