摘 摘 要 电子商务合同是平等主体的当事入之间通过计算机网络达成的 设立、变更、终止财产性民事权利义务关系的协议。它与传统民事合 同的明显区别在于：电子商务合同的订立是通过计算机网络来完成 的。电子商务合同的违约救济制度是指对电子商务合同履行过程中因 对方当事人违约而受到损害的当事人进行救济的各种法律规范的总 称，主要包括电子商务合同违约行为的认定、电子商务合同的违约救 济方式和电子商务合同违约责任的承担等制度。电子商务合同的违约 行为以其成立生效为前提。由于电子商务合同订立的特殊性及订立过 程中双方当事人对对方当事人认定的困难，对其违约行为主体的认定 应有一些特殊规则。对电子商务合同的违约救济方式主要有电子自 助、民事诉讼方式、在线纠纷解决机制。法律应确定电子自助的合法 地位并对其作出限制；法院诉讼方式必须要解决法院司法管辖权的确 定问题，法律适用的确定问题以及电子记录的证据效力问题；在线纠 纷解决机制在电子商务合同纠纷的解决中具有重要的地位。在电子商 务合同的违约责任承担方面，传统的违约责任的归责原则仍然可以适 用，但出现了一些新的免责事由，如某些情况下的网络中断或障碍等， 承担违约责任的形式也出现了停止使用、终止访问等形式。我国应从 事先预防和事后救济两方面来完善电子商务合同的违约救济制度。 关键词：电子商务，电子商务合同，违约救济制度 ABSTRACTThe ABSTRACT The Electronic Commerce Contract(EC Contract)iS all agreemem for forming，changing，ending the property relationship of civil fights and duties of the equal subjects，which iS concluded through the intemet．The obvious difference between the EC Contract and the traditional contract iS 豳at the EC Contract is concluded through the intemet．乃e System of Remedies for Breach of the EC Contract iS a sum of legal rules which provide the parties concerned reliefs when they encounter breaches．It mainly includes the system of recognition of the breach．the system of remedies for the breach and the system of undertaking of the llability．The breach happens after the EC Contract becomes effective．Because of its particularity of conclusion and the difficulty of the identification of the other party,some particular rules should be formulated in the system of recognition of the subjects．The remedies for breach in the EC Contract mainly include Electronic Self-service，civil action and the Online Dispute Resolution．The law should establish the legal position of the Electronic Self-service and restrict its application．The remedy of civil action needs to solve some problems，namely the definition of the court’S iurisdiction，the definition of the suitable 1aw and the proof effect of the electronic datum．The Online Dispute Resolution is important in the solution of the dispute of the EC Contract．In the
