1 1 2 2 内容摘要 随着社会经济的不断发展，交通工具日益普及，交通事故数量急剧上升，其中不乏 重大恶性交通事故，酿成严重后果，给人民的生命财产安全带来威胁。因此，对交通肇 事罪的理论研究、实务探讨具有深远的学术价值和社会意义。笔者通过对交通肇事罪在 我国刑法中的交替演变，并对某区人民检察院近三年来受理案件的情况进行统计分析， 从法律规定、理论探讨、实务研究三个角度全面分析交通肇事罪，针对交通肇事罪中的 主体、量刑、自首、交通肇事后逃逸、精神损害赔偿、刑事和解、国家补偿等多个焦点、 热点分体进行分析和研讨，并提出笔者的观点。同时，笔者结合近年来国内发生的一些 著名案例进行法律剖析，以期获得更加深刻的认识。交通肇事罪的研究还有待专家学者 和实务工作者进行深入、持久的研究，立法工作的不断推进也将完善该罪名的定罪量刑 问题，以期带来更好的法律效果和社会效果，笔者在此仅起抛砖引玉的效果。 关键词：交通肇事罪；理论研究；实务探讨 Abstract With the continuous development of economy, transport increasing popularity, the sharp rise in the number of traffic accidents, many of them major or fatal accidents, causing serious consequences to peoples lives and property at risk.
