摘要 摘要 万方数据 万方数据 摘 要 交通警察行政强制是指公安机关交通管理部门及其工作人员在实施交通管 理或查处交通违法案件以及处理交通事故的过程中，为了实现法定目的，而依 法对公民、法人或其他组织的人身、财务或者行为予以强制性约束或处置的具 体行政行为。它通过具体的强制形态，如扣留车辆、扣留驾驶证、拦截车辆等 来实现。虽然交通警察行政强制是实现道路交通安全管理、保障交通秩序，预 防和减少道路交通事故的发生、提高道路通行效率所必不可少的手段，但由于 其强制性的本质特征，生来便存在着权力越轨、侵犯相对人权益的天性。我国 2011 年通过、2012 年开始实施的《行政强制法》对行政强制行为进行了细致的 规范，对行政强制中公民权利的保障提出了更高的要求，但现行的交通安全管 理法规中还有很多与《行政强制法》存在矛盾与冲突之处，不利于公民权利的 有效保障，需要我们采取措施作出一定的改进。 关键词：交通警察；行政强制；冲突；完善 I Abst Abstract ABSTRACT Traffic police administrative enforcement means in order to achieve the purpose traffic management and order, traffic management department or by the peoples court for traffic participants in their persons, property or acts of coercion or take other actions, it forced through specific forms, such as the detention of the vehicle, detain a drivers license, intercepting vehicles and other specific mandatory form to achieve.
