万方数据 万方数据 摘 要 我国人口老龄化进程日益加快，养老问题日益凸显。政府购买居家养老服务是政 府利用社会资源，引进市场竞争机制，采取合同化的方式提高政府效率，解决养老问 题的方式之一。其涉及政府、养老服务提供方、老年人三方主体，通过引入为第三人 利益合同理论，分析这三个主体法律关系，并在此基础上探讨各主体应承担的法律责 任。本文采用比较分析和文献分析的方法界定政府责任，得出政府承担违约责任的方 式具有特殊性以及在一定条件下政府对老年人承担补充责任。采用案例分析法，对养 老服务提供方与老年人纠纷进行类型化，并结合现行法规，分析养老服务提供方责任。 本文除前言和结论以外，共有四章：第一章主要界定居家养老服务合同主体及其 法律关系。主要从政府购买模式下居家养老服务合同中主体与服务内容存在特殊性出 发，以为第三人利益合同理论分析政府、养老服务提供方与老年人的法律关系，为后 文探讨各主体的责任奠定基础。 第二章探讨居家养老服务合同中政府的责任。从政府对养老服务提供方承担违约 责任与养老服务提供方侵害老年人后政府应承担的责任两个方面分析。通过研究发 现，政府对养老服务提供方承担违约责任存在困境，并据此提出完善政府承担违约责 任的建议，即加强对政府行为的事前事后控制。通过设立政府违约赔偿基金保障合同 相对人的权益，维护政府的公信力。养老服务提供方侵害老年人权益后，基于国家担 保理论和德国关于公私合作各主体责任界定的相关理论，政府在此情况下应承担补充 责任，以填补老年人的损害。 第三章探讨居家养老服务合同中养老服务提供方的责任。基于政府与养老服务提 供方的合同特殊性，若其违反相应的特殊义务，如信息披露、接受政府监督等，其应 承担违约责任。在养老服务提供方与老年人的关系中，区分有无合同情况，从侵权和 违约竞合角度以及为第三人利益合同角度界定养老服务提供方的责任。 第四章探讨居家养老服务合同中老年人的责任。从老年人对政府的责任以及老年 人对养老服务提供方的责任两方面分析。在为第三人利益合同理论中，政府与老年人 是对价关系，如果老年人采取欺骗等手段，享有政府购买居服务的利益，其构成不当 得利的返还责任；如老年人在接受服务过程中违反诚实信用而产生的附随义务，其无 须承担违约责任。但若侵害养老服务人员的合法权益，则应依据侵权责任法承担侵权 责任。 关键词：居家养老服务合同；政府购买；为第三人利益合同；法律责任 ABSTRACT Population aging process in China is accelerating and pension issues become increasingly prominent. Government purchase of pension service is the way to solve the pension problem, which is taken fully use of social resources, introduced market competition and contract to enhance government efficiency. Government，pension service provider and the elder are the contract parties. By introducing the theory of the third party interest contract and analyzing the legal relationship among them, we conclude that what legal responsibility they should be followed. The article adopts the method of comparative analysis and literature analysis to define the government responsibility. It is concluded that the government responsibility of breach of contract method has a certain particularity and under certain conditions the government should bear the supplement liability for the elderly.
