Abstract
Occupational crimes are severe corruption behaviors. Preventing and punishing occupational crimes is not only the important obligation of the legal institutions, but also large social system engineering. Only depending on the joint efforts of the whole society and the government, we could prevent and decrease those corruption behaviors strongly and effectively, thus strengthening the anti-corruption achievements.
The occupational crime refers to the behaviors and nonfeasance behaviors that endangering the normal functioning of government departments, jeopardizing the impartial and incorruptible reputation of government departments, harming public and private properties, national and citizen?s interests, and the citizen?s rights of person, by the working staff of the state organs who making use of his or her privilege or official position, to break the law or disobey the disciplinary rules related to his or her duties, occupy the public properties illegally, misappropriate public funds, accept funds and articles from the others, abuse his or her authority, play irregularities for favoritism and neglect his or her duty.
The research has 6 chapters. Chapter 1 gives a brief introduction of occupational crime. It discusses the definition, characteristics and types of occupational crimes, analyzes the jeopardy of occupational crimes and the importance of prevention. Chapter 2 analyzes the causes of occupational crimes from both subjective and objective aspects.,and provides the analysis of different periods and their characteristics of occupational crimes, which dividing occupational crime into three periods as the potential period, the factual period and the deteriorating period. Chapter 3, 4, and 5 deals with the above three periods of occupational crime respectively, tell us how to define each period basing on the causes and evidences. Chapter 6 tries to bring up prevention methods of occupational crime.
