国际经济法视角下的非政府组织 国际经济法视角下的非政府组织 Abstract With the development of global economy, non-governmental organizations (NGOs) are playing a more and more important role on the stage of international economy, so as to provide a new perspective to solve social issues accompanying economic globalization. NGOs have deeply involved in international economic and social matters, and it is the consequence of pluralism. With the rising of NGOs, various issues have come in to being, and theories on the international economic laws are now facing serious challenges. Then, how should we define the position of NGOs in international economic laws, and how to avoid the problems in the development of NGOs? Those are the questions this paper tries to discuss. The introductory part introduces to the intention of this research, the current studies on this subject, and the significance of this study. The main body of this paper is comprised of four chapters. In chapter 1 the discussion is around the concept of NGOs, the background of its emerging and the development by now through probing briefly theories on NGOs. Then, some cases are cited in chapter 2 to illustrate the major functions of NGOs in international economic laws. The focus is on the necessity for NGOs to participate in this field. Chapter 3 is the main part of this paper. Three perspectives and the relevant theories on the functions of NGOs in international economic laws are reviewed. Then, we will look at the subjective elements of international economic laws, especially the possible categories for these elements. On the basis of this discussion, we insist NGOs occupy a subjective position. Disadvantages of NGOs should be recognized as well as their advantages. So, the current development of NGOs and problems of them, especially problems with NGOs in China, are analyzed in Chapter 4. Some suggestions are put forward on how to avoid these problems and to improve the development of NGOs. The paper is concluded that NGOs have been an
