论文 论文摘要 PAGE PAGE 1 PAGE PAGE 2 本文分为四个部分。前言部分主要说明了本文的由来、写作思路以及致谢。 第一部分，是即成性行政行为和后续性行政行为分类的基础研究。首先在理论上对 这对范畴的内涵以及分类标准作了说明。然后以一个案例为引，从现实的层面给人以该 对分类存在形态的直观感受。接下来又回到理论层面，将该对范畴与相关易混淆的概念 作了比较说明。最后，从大家熟知的行政行为入手，补充了即成性行政行为与后续性行 政行为的外延，以期完整阐述即成性行政行为和后续性行政行为分类的基础部分。 第二部分，是即成性行政行为与后续性行政行为的分类在实务中的运用，主要从该 分类在行政程序立法和行政诉讼法的修订两个方面入手。在行政程序立法部分，首先回 顾了国内外关于行政程序法的理论与实践，然后分析利弊，提出建立在即成性行政行为 与后续性行政行为的分类基础上的立法构想。在行政诉讼法的修订部分，由一个案例入 手，引出现行诉讼法在诉讼实践中的困境；最后阐述了如果将本对分类融入行政诉讼法 会产生怎样的积极效果以及其对于走出现实困境、拓宽司法审查范围的意义。 第三部分，是即成性行政行为和后续性行政行为的分类与行政行为的类型化。在回 顾了国内外关于行政行为类型化的理论后，总结本文一、二部分的研究成果，提出了以 即成性行政行为和后续性行政行为的分类为基础的新的行政行为的类型化模型。 关键词：行政行为；分类；行政程序；行政诉讼；类型 Abstr Abstract PAGE PAGE 3 PAGE PAGE 4 This article is divided into four parts. The foreword part mainly explaines this article origin, the writing mentality as well as the acknowledgment. The first part, is the basic research which the Immediate administrative action and the following administrative action classify. First explains these theoretically to the category connotation as well as the classified standard. Then take a case as the example, lets the human feel their existence from the realistic stratification plane. Then returns to the theory stratification plane, compared with these categories and confused concepts. Finally, obtained from everybody knowledges administrative action, to supplement the immediate administrative action and the following administrative actions extension, hopes could elaborate completely the immediate administrative action and the following administrative action classified foundation part. The second part, is the immediate administrative action and the following administrative actions classification in the practice utilization, mainly obtains from this classification in the administrative procedure legislation and the administrative procedural laws revision two aspects. In the administrative procedure legislation part, first reviewes domestic and foreign about the administrative procedural law theory and the p
