the the research of patients’rights building Civil and Commercial Law Postgraduate：Liu Ziyan Supervisor：Li Minghua Abstract：In recent years，the Medical dispute is increasing in our country,the doctor-Datient relationship is deteriorating，and the Medical disputes accident happen 行equently．Medical dispute is a worldwide difficult problem which has been recognized as the most troublesome case in the judicial practice．Medical disputes once occurred， the patients，physicians，hospitals and medicine，law and insurance companles and other social people from all walks of life are concerned about the handling of disputes very much． Between the doctor-patient relationship，the authority of the professional medical knowIedge，health behavior of patients with high risk all make patients naturally in a passive and vulnerable position．As the patients’rights consciousness IS growing， Datients who don·t want to always passive acceptance of diagnosis and treatment，the aim is to hope that doctors use the most reasonable way of diagnosis and treatment to help restore their health when they go to the hospital for medical treatment，rather than simply gave themselves all to the hospital．Patients hope that more and more involved in the diagnosis and treatment process in order to supervise the behavior of medical diagnosis and treatment effectively,legal remedies can be performed to the infringement of their rights．But SO far,our country has not yet been a patients’rights protection law, does not have a clear concept of patients’rights also，most of patients’rights are concIuded bv rules for physicians and obligations，and mixed in the human dignity,the right to life and the right to health，etc．Therefore，patients are still unclear the definition of rights．Corresponding，a lot of interests have been legalization，SO once the interests of Datients and health providers’conflict，even prescriptions have the unreasonable behavior．something still Can be used to protect their rights and interests on the b
