I I 民间慈善组织合法化问题研究 中文摘要 民间慈善组织合法化问题研究 中文摘要 慈爱善良作为中华民族的传统美德，有着悠久的历史。考察近代至今的慈善业， 其发展迅速且已成一定规模。但纵观我国慈善组织的现状，部分官办慈善组织遭遇信 任危机，部分民间慈善组织则因各种原因未能在制度框架内合法化，存在着一定的发 展瓶颈和生存困境。尽管如此，民间慈善组织的作用仍日益彰显出来。他们可能未经 注册，或遭取缔，但他们的善良爱心是人性体现，且结社自由是宪法保护的公民人权。 公民通过加入民间组织特别是慈善组织参与社会管理，这是发达国家的先进经验，既 能补救政府管理之不足，又可减少社会矛盾。同时参加民间慈善组织的活动也是公民 参与的一种有效实践，它建立起公众参与公共事务的渠道，为政府与市民间的沟通起 到桥梁作用。为切实解决当前民间慈善发展的困难，本文试为其提出几个建议，比如 统一慈善的立法，降低注册标准，为其提供更多优惠措施，或借鉴国外的信托模式等， 力求将民间慈善组织这一默默行善的群体早日合法化。 关键词：民间慈善组织 结社自由 合法化 作 者：吴江荻 指导老师： 庞凌 II II 英文摘要 民间慈善组织合法化问题研究 The Research of Legalization of Folk Charity Organizations Abstract As one of the old Chinese traditions, charity has a long history. In late centuries, the charity works have kept its relatively large amount and have developed rapidly .But considering the current situation of the charity organizations in China, of both governmental and folk charity organizations, they are going through some challenges in surviving and have met their bottle necks in the development. As a result, the folk charity organizations have showed its functions while governmental charities facing to trust crisis problem in lately news. Many folk charities might not be registered or be cancelled, but the goodness revealed through this channel is the representation of humanism. And more importantly freedom of association is human right guaranteed by any country’s constitution. The citizens have played an important role in society management by joining folk organizations, and charity organizations in particular. This is the excellent experiences gained from the developed country, and it can reduce the fractions and played the role as the communication bridge between the government and citizens.
