摘 要 随着经济的发展和居民收入水平的提高，旅游行业快速发展，世界各国对旅游 保险的需求也随之不断增强。作为各国旅游业的核心要素，旅行社因其行为及服务 所承担的相应责任也日益广泛、复杂。在这种背景下，旅行社责任保险应运而生且 随之经历了不同程度的改革与创新。如何更好地通过制度设计及保险安排以使旅行 社责任保险更好地发挥其作用，对于政府、行业及消费者而言都是十分重要的问 题。 本文在对旅行社责任保险的基本内容及发展过程进行全面分析的基础上，运用 博弈论分析法和国际比较研究法，选取最具代表性的美、英、日三国，针对旅行社 责任保险监管中的法律强制性要求，以及市场运营中的发展历史、运营模式、险种 设计三方面进行较为全面的理论逻辑分析和比较分析，总结了三国模式的特点与优 势。借此为正处于初级阶段的我国旅行社责任保险的发展提供一些借鉴，并进而有 针对性地提出完善与完善我国旅行社责任保险的政策建议。 关键词：旅行社责任保险，国际比较，启示 Abstract With the vigorous development of economy and the rising of income level, industry of travel and tourism has been growing fast, the demand of travel insurance in the world is growing as a result. As a core element of travel and tourism, travel agencies’ liability to travelers for their acts and services becomes increasingly abroad and complicated. In this background, travel agency liability insurance came out and then experienced various reforms and innovation. For both government and industry, how to make the existing regulation system and insurance design to improve travel agency liability insurance has been an important topic. After a comprehensive discuss of travel agency liability insurance, according to the Game Theory analysis and comparative study method, this thesis analyzes the differences among travel agency liability of the most representative countries-- the United States, Britain and Japan, by making comparisons in different perspectives such as the legal requirement of travel agency liability insurance, the history of travel agency liability insurance, business model and the design of insurance lines. Based on these analyses, this paper will summarize the characteristics and advantages of these three modes, and then provide references and suggestions for the further development and improvement of travel agency liability insurance in China.
