Factors of hindering criminals’ human rights of our country from realizing are in many aspects.The first:political respect.Political is a very wide concept,any unreasonable factor may lead to an obstacle in realizing criminals’ human rights.Our government lay stress on “ruling by man” rather than “ruling by law”,which lead to the slowness of the construction in demonstration and legal process.Besides ,lack of concept “governed by law” made the law lack of leading quality in the society.This situation hindered criminals’ human rights from realizing in China.The second:leagal aspect.Imperfect legislation is another important factor in restraining realizing criminals’ human rights in our country.The third: economic respect.Economic factor is the material base of criminals’ human rights realization.Macroecnomy situation and policy not only restrain the improvement of the whole criminals’ human rights level,but also influent deeply the micro rights which every criminal should have .The economic strength at present in our country restrict further development and realization of criminals’ human rights.Deficiencies of funds in prison lead to natural alienation in criminal work.This influences the realization of criminals’ human rights in our country.The fourth: social cultural tradition aspect.In history of our country ,the concept of human rights and human rights protection fainted,because our country is lack of social culture fundation about “right” with the “obligation standard”in the history. The realization of criminals’ human rights is a comparatively complicated engineering system.It needs participation of the whole country,cooperation and support of many department and implement
