内容提要(法治观念源远流长，系统的法治理论也有悠久的历史。在古今中外政治学说 内容提要 (法治观念源远流长，系统的法治理论也有悠久的历史。在古今中外政治学说 ＼ 发展史中，法治是理论家们反复研究的一个课题。本文仅就20世纪的西方法治 、 观念做简要梳理和粗浅分析，意在促进本人的学习。7L 本文首先通过对西方法治观念的源流的简述，指出西方法治思想发源于古希 腊、古罗马，至20世纪前有了很大发展，并成为20世纪的西方法治观念的基 础。 接着本文通过分析20世纪的西方法治观念对传统西方法治观念的继承与批 判，指出二者之间的联系和区别；通过对20世纪的西方法治观念的主要内容一 一法治与民主宪政、法治与自由、法治与正义、法治与道德、法治的原则、法治 的模式等的简述，试图理清其基本内涵。 然后本文通过简要的分析，揭示20世纪的西方法治观念在历史上、地域上 的局限和自身模式上的矛盾。进一步指出，20世纪的西方法治观念所提供的法治 模式并非完美无缺、放之四海皆准的唯一模式。 最后，本文指出，20世纪的法治观念是一个内容丰富的概念，也是一种价值 取向明显的意识形态。r在社会主义民主法治建设进程中，应该对20世纪的西方———’＼ ～ 法治观念在理论上做科学的分析批判、取长补短、为我所用；在实践中做到理顺 权力、权利的关系，做到法治与德治的完美结合，在全社会普及法治观念。』 关键词：西方·法治观念 2 ABSTRACTThe ABSTRACT The ideas of rule by law have a distant source and a 10ng stream and the systematiC theories of rule by law have an age—old history． During the developing history of political science in modern OF ancient times．in China or elsewhere，rule by Iaw iS a question for theoreticians to study over and over again．Aiming at promoting my study，the paper will comb simply and analyze superficially the OCCidental ideas of rule by law in the 20。h century． At the beginning，by recounting simply the origin of the occidental ideas of rule by law，the paper points out that the occidental ideas of rule by law originated from the ancient Greek and Roman and developed greatly before the 20。h century and became the basi s of the occidental ideas of rule by law in the 20n century． In the following part the paper analyzes that occidental ideas of rule by law succeeded and criticized that traditional occidental ideas of rule by law and the paper also points out the relations and differences between the two．By relating simply the main contents of occidental ideas of rule by law in the 20b century，such as rule by law and democratic constitutionalism，rule by law and 1iberty，rule by law and justice，rule by law and morality，the principle of rule by law and the pattern of rule by law，this part tries to make the basis connotation of rule by law clear． After that． by analysing the contradicto
