China’S China’S refo·rm the land contract．In Plenary Session”on agriculture and lural work in a number of major lssuesmade clear：”long—term stability to the household contract as the basis for reunification by the combination of the two-tier management system”’’Farmers make their own decisions to establish a market dominant position¨and¨to give farmers long—term and secure land use fights．”Amendments to the Constitution(1 999)from the nation’S basic law formally established the¨rural collective economic organizations to implement the household contract based system by the combination of the two-tier management system．”March 1，2003 shall come into force of”The People’S Republic of China Rural Land Contract Law¨togive farmers long-term and secure land use fights，maintenance of rural land contracting parties of the legitimate rights and interests¨as the basic legislative purpose，while giving the transfer of land principles． However,land contract and management fights of protection have not been properly resolved，and how to regulate and strengthen the land transfer is urgent to solve the problems．How to combine the practical implementation of China’S policy of land is reasonably practicable，which we need to combine research and practical experience at home and abroad． The fight to land contractual management to adapt to China’S national conditions and established the rights with Chinese characteristics，there is no legislation in the foreign concept．Foreign law on land economics and land studies，and rarely use the term land transfer．Foreign scholars on the land transfer of the land transactions arc reflected in，land rent，land transfer model and the relevant land transfer market research theory is the premise and basis for land transactions．On land contracting right，in recent years have become the land of Land Economics and one of the most popular legal circles，mainly due to the development needs of China’S market economy and the promotion of land reform．Domestic experts
