摘要摘要 摘要 摘要 死亡赔偿金问题一直以来都倍受民法学界和社会各界的关注。死亡赔偿金在 法律适用中仍有许多问题需要学术界和实务界共同研究和探讨，具有较高的理论 价值和实践意义。本文将就死亡赔偿金法律适用中的一些问题进行探讨，如死亡 赔偿金的概念、性质、适用要件及适用难点等。 本文的第一章，概括论述对死亡赔偿金的界定以及死亡赔偿金的性质。“死 亡赔偿金’’，作为我国立法上特有的概念，经历了从“抚恤补助”，到“死亡补偿 费，再到“死亡赔偿金”的演变过程。我国立法上首次明确使用“死亡赔偿金 概念的是1994年的《消费者权益保护法》，其第42条明确规定：“经营者提供商 品或者服务，造成消费者或者其他受害人死亡的，应当支付丧葬费、死亡赔偿金 以及由死者生前扶养的人所必需的生活费等费用。 关于死亡赔偿金的性质，有财产损害赔偿和精神损害赔偿之争。本文将在第 一章的第二部分对此问题作一定的阐述，以说明将死亡赔偿金界定为财产损害赔 偿的依据及合理性。 本文的第二章，将对死亡赔偿金司法适用的一般要件进行论述。就死亡赔偿 金的适用要件，本文将分别从适用主体、适用的主观要件和适用的行为要件三个 方面展开论述。 本文的第三章，也是文章的最后一部分，将就死亡赔偿金在规范适用中的难 点问题进行一定的探讨。文章主要对其中的三个难点进行论述，即《中华人民共 ’和国侵权责任法》第十七条的适用问题、死亡赔偿金的计算标准如何确定及死亡 赔偿金的范围问题。 关键词：死亡赔偿金，财产损害赔偿，法律适用 AbstractAbstract Abstract Abstract nle problem of Death Compensation Funds has been much civil academic and society concerns．In the law of application of Death Compensation Funds，some problem still need tO be researched and discussed commonly by academics and practice，because tlley have higher value in theory and significance in practice．111e thesis will discuss on some problem in the course of law application of Death Compensation Funds．There are some problem，such as concept,character,applicable elements and applicable difficulties． ne first chapter of the thesis will generally discuss the concept and character of Death Compensation Funds． As a peculiar concept in legislation of our country,”Death Compensation Funds” experienced a evolution process from”Pension Subsidies”to”Death Compensation Expense”to”Death Compensation Funds”．Inl 994，Law of the PRC on the Protection of the Rights and Interests of Consumers，the concept”Death Compensation Funds” Was used and it also Was firstly and clearly used in legislation of our country．砀e Article 42 of the law explicitly stipulated that：A business operator that causes the death of a consumer or other party in providing a commodity or a service shall pay expenses such as funeral costs，death compensation funds and the living expenses necessary for the persons that depended on the victim while alive．
