论中国生态资源保护法的构建摘 论中国生态资源保护法的构建 摘 要 生态资源是中华民族赖以生存的基本条件，是国民经济持续发展和社会繁荣 的物质基础。如何合理利用生态资源，保障生态资源可持续发展，越来越受各国 政府和研究机构的普遍关注。生态伦理学与可持续发展理论的提出为我国生态资 源立法提供了理论前提；生态资源的破坏和枯竭为生态资源立法提出了现实要求； 十六大的指导思想为生态资源保护立法提供了时代契机，因此建构一部生态资源 保护基本法是实现我国新时期战略目标的重要保障。 本论文针对我国生态资源开发、利用、保护与管理无得力法规可循的现实， 根据立法学的理论，参照国外环境法和我国的资源法、环境法及有关法规，力求 为尽快制定适合我国国情的生态资源保护法，保障生态资源的可持续发展做一些 有益的探索。全文共分五部分。 第一部分：中国生态资源立法的客观基础 第二部分：中国生态资源立法的国际趋向 第三部分：生态资源保护法的目的与指导原则 第四部分：生态资源保护法的基本理论建构 第五部分：生态资源保护法律关系的建构 关键词：生态资源 保护法 构建 AbstractThe Abstract The ecological r／esources are the primary condition that Chinese nation relys on．They are the material foundation on which the national economy develops sustainably and the society prospers as well．The question which seizes the universal concerns of the governments and ensHre the sustainable development of it．Putting forward the ecological ethics and the sustainable development theories have offered the theoretical prerequisite for legislation of the ecological resources in China．The fact of the destruction and exhaustion of the ecological resources are demanding this kind of legislation．Also a critical point is given for us to legislate for ecological resources conservation under the spirit of the 16th Party Congress．Therefor,the conservation law is very helpfIll to realize our COUat2y’S strategical target at this period oftime This thesis is directed against the reality that there is no powerful laws to direct the exploitation，utilization,protection and management of our country’s ecological resources． According to the theory of the legislation and references on relevant laws and regulations home and abroad．This thesis strives to draw-up the law to protect ecological resources，which is suitable to the state of our country as soon％possible．And some helpful resources are made in it on ensuring the sustainable development．The whole thesis is divided into five pans． The first part：the general situation ofthe ecological resources in China． The second part：the international trend ofthe l
