论青少年保护的政府责任摘 论青少年保护的政府责任 摘 要 青少年是国家的希望与未来，为使青少年健康发展，应该积极保护青少年的 基本权益。青少年有受教育权、劳动就业权、居住权、健康权、社会保障权、社 会福利权、政治参与权、司法保护权等八个基本权益。 政府应该承担保护青少年的责任。青少年权益保护的主体主要有国家机关、 社会团体、家庭、学校，其中政府是主导性责任主体，其他为协助性主体。政府 因为公民的权力委托而掌握着公共权力，有义务去保护青少年，也因为政府支配 着公共资源，有能力去保护青少年。对青少年后发性弱势群体，政府更应该有义 务去保护。 政府承担保护青少年的责任，体现在政府要承担必须的法定责任和承担自觉 的道义责任。 政府有效承担青少年保护责任的途径，主要是政府在坚持以人为本、社会公 正的理念和转向公共服务职能的前提下，要建立保护青少年的工作体制，设立专 门的保护青少年的政府组织机构，针对政府对青少年保护的“碎片化”现象，借 鉴域外国家与我国部分地区的政府组织设立的经验，我国可以选择设置“青少年 保护中心”这样专门的常设性实体机构；健全运行机制，科学制定青少年保护的 政策，明确定位青少年政策的价值取向，建构无缝隙政策文本框架，保障青少年 政策参与：落实责任追究，明确责任主体的具体责任，将青少年保护工作成效纳 入政府绩效考评体系。 关键词：青少年，权益保护，政府责任 【中图分类号】：C 913．5，D 63 2 论青少年保护的政府责任Abstract 论青少年保护的政府责任 Abstract The juvenile are the hope and the future of country．In order to keep them developing healthily,we should actively protect the juvenile’S basic fight．The juvenile entitled to the eight basic rights namely：education，employment， habitation，health，social safeguard，social welfare，political participation and judicial protection． 111e government shall bear the responsibility for protecting the juvenile．m subject to protect the juvenile includes the state organs，social groups，family and schools．among which the government iS the malnline subject and the otherS are the assistant subjects．11le government．because of the delegation of powers from the citizens，iS committed to protecting thejuvenile；alSO because ofthe domination ofthe public resources，arc capable of protecting the juvenile．Viewed from the reason of the problem in the later-ness for the juvenile to be the weak group，because of the vacancy and the weakness of the government in protecting the juvenile,the government shall bear the main responsibilities． The responsibilities ofthe government to protect the juvenile are reflected in that the govemment shall bear the compulsory legal responsibilities and consciously bear the morality andjustice responsibilities： The channels for the government to effectively bear the responsihilities of protecting the juvenile mainly lies in t
