中文摘要中文摘要 中文摘要 中文摘要 科技日新月异的进步，导致了犯罪的手段也日益的纷繁复杂，这就使得传统 的侦查方式遭到了前所未有的挑战。在此种背景之下，秘密侦查措施也就顺势而 为、应运而生了。但在我国的司法实践中，秘密侦查因其自身固有的优势与缺陷 而一直在法学界争议不断，这同时也显现出了我国秘密侦查制度在立法上的缺失。 2012年新《刑事诉讼法》关于技术侦查的明确立法，让秘密侦查不再处于秘密朦 胧的状态，也在立法上为秘密侦查制度的完善提供了一个良好的开端。以往，由 于我国秘密侦查制度的不透明，侦查人员在适用时往往就具有随意性与普遍性， 因此这一措施也就极容易造成滥用与腐败。此外，秘密侦查在实施过程中也忽略 了对侦查人员以及侦查对象的保护，导致在人权保障与国家保卫之间产生了矛盾。 如今，尽管秘密侦查已经有法可依，其在制度方面的规制仍旧有所不足，亟需进 一步完善。在分析了我国新《刑事诉讼法》中关于秘密侦查制度的不足之后，今 后我国的立法可以从适用主体及对象、适用范围、启动条件、审批程序、适用原 则、权利保障等方面来进行完善，提出符合我国国情与实践的建议，使之能在更 有效的打击犯罪同时，也能在保障人权方面达到一个平衡的状态。 关键词：秘密侦查；权利保障；法治化 万方数据 黑龙江大学硕士学位论文Abstract 黑龙江大学硕士学位论文 Abstract With the rapid progress ofscience and technology,the means ofcrime also become more and more complicated，which makes the traditional way of investigation meet up with the unprecedented challenges．In this situation，secret investigation measures are born by the occasion．But in judicial practice of our countlaf，secret investigation has arouse the disputes constantly because of its advantages and disadvantages，at the same time，it also makes US realize the loss of secret investigation system in legislation．In the year 2012，the new“Criminal Procedural Law”adds the technology investgation，which means the secret investgation is longer in that hazy state，and also provides good start for the improvement in the legislation of secret investigation system．During the past time，because of the uncleaness of China’S Secret Investigation System，the investigators in the application often random and universal，SO this measure is very easy to cause the abuse and corruption．In addition，the secret investigation in the implementation process also ignore the protection of the investigators and the investigation object，resulting in the contradiction between the protection of human rights and national security．Today,although the secret investigation has laws to comply, the system of regulation is still inadequate，and needs to further improve．After analyzing the shortcomings in our country in the new”Criminal Procedural La
