I I 摘 要 摘 要 赡养老人，是中华民族的优良传统，在法律层面上讲，也是赡养义务人应尽的法律 义务。随着老年人口大量增加，我国的老龄化程度不断加深，同时由于计划生育政策的 施行，形成了很多“四二一”家庭，弱化了家庭功能，原来的赡养立法制度很难实现老 年人赡养的家庭功能，于是，我们不可忽视老年人的赡养问题。 新修订的《老年人权益保护法》于 2013 年 7月1 日开始施行，法律在明确规定物 质赡养的基础上，增加了精神赡养的规定，但是在实际的法律适用过程中仍没有很好的 保障老年人的合法权益，是因为法律规定过于笼统，缺乏针对性和可操作性。可以说， 我国老年人受赡养权的法律保护仍存在不足，主要表现在立法保护缺乏可操作性、司法 保护、行政保护力度不够、老年人赡养种类单一、社会保障制度不够完善等。 老龄化问题不仅是困扰我国的社会问题，而且是一个世界性的问题，本文在对世界 其他国家和地区老年人受赡养权法律保护探究的基础上，借鉴他们的成功经验，分析我 国老年人受赡养权法律保护的现状与不足，认为应从立法、司法、行政保护等方面加强 对我国老年人受赡养权的法律保护，包括完善立法、加强赡养权的司法保障、加强行政 保护力度三个方面，以期逐步完善我国老年人受赡养权法律保护制度。 关键词 老年人 赡养权 保障 制度完善 II II Abstract Abstract Supporting the elderly, is the fine tradition of the Chinese nation, the legal level, also support the obligation of legal obligation.
