? 中文摘要 网络作为…种新兴的倍息传播媒介，被人们称为继报纸、广播、电视之后的 第四媒体，在媒体中占有越来越重要的地位。作为一种新兴的信息传播工具， 四特网正迅速普及，对人们的生活，工作学习带来了革命性的冲击，改变着人们 的生存方式。但是，网络的发展也给各种各样的侵权、违法行为提供了极大的方 便，网络对法律提出了新的挑战，网络的发展尤其对著作权的影响颇大。故需要 通过增强知识产权保护来应付这些新的挑战。为了保护著作权人的合法权益，规 范网络环境下对作品使用的正常秩序，以及促进网络信息业的健康发展，急需相 关法律作出相应的规定。从现存的著作权保护制度和国际上通行的作法来看，主 要是通过著作权集体管理制度来解决网络上著作权的侵权行为。著作权集体管理 正是适用于网络环境解决网络侵权的…种集中的、规模化的、经济的方法。 第一部分作者简介了著作权集体管理的概念和起源发展、网络著作权集体管 理的新的发展、特征，说明了在网络环境下，著作权集体管理的存在和发展是极 其合理的。 第二部分介绍了国外网络著作权集体管理的发展情况，由美国、法国、德国 等国的发展情况对比我国网络环境下著作权集体管理的发展情况。 第二部分主要是现今网络环境下著作权集体管理的几种法律模式，模式中包 括了制度模式和竞争模式和我国现今使用的各种模式，适合我闺阁情的模式是垄 断性模式和官方模式。 在第四部分介绍的是我国的垄断模式和官方模式荷着不足，易造成垄断，我 国应借鉴国外在著作权集体管理模式方面的先进经验，加强监督管理，更好的进 行完善。 失键词:网络环境著作权集体管理模式完善监督 ABSTRACT Intemetωa new infonnation media， after the newspapers ，radio and television ， h部 been called 由e media， which plays an increasingly important role.
