The labor right is a fundamental right of citizens, and it is an important content of citizens human rights. So many countries in the world clearly protect the labor in the constitutions. In recent years, with the rapid development of Chinas construction of the rule of law ， and gradually establish a system of legal protection of labor rights of the handicapped ， the blind has been significantly improved in the field of labor and employment, but there are still many difficulties. Because the blind restricted by the factors of the congenital or acquired, most of them are engaged in health care massage, and it caused the employment rate is low, the employment is single and so on. The structure is not reasonable, discrimination, insult, abuse and mutilation of the disabled workers occurs from time to time. These phenomena seriously infringed upon the rights and interests of the disabled, and it can not be ignored, the state and society must give them enough attention and concern. Therefore, the author attempts to use through to the basic theory of constitutional law and administrative law, find out the existing problems in the process of employment from multiple angles, and analysis of the causes of the problem, American, Germany and other countries or regions on the inspection to protect the blind man labor rights related laws or policies, seeking to solve the blind Chinas employment difficult way, and puts forward some suggestions to perfect, to fully implement the constitutional rights.
