贵州大学硕士研究生学位论文 贵州大学硕士研究生学位论文 I I 论小额贷款担保制度完善 中文摘要 物权担保制度是市场交易关系的稳定发展所不可或缺的制度，担保制度自古 罗马法以来，一直受到各国立法与判例重视，并处于不断完善过程中。自改革开 放以来，我国对担保物权制度的建立和完善给予充分的重视，《民法通则》、《担 保法》、《担保法司法解释》及《物权法》构成我国担保物权法律体系。担保制 度的健全和完善能够大力促进金融的繁荣，特别是《物权法》在贯彻执行《担保 法》实践经验的基础上，吸收了社会经济生活中的许多成熟的经验，借鉴了外国 的一些成熟的做法，对《担保法》中担保物权部分进行了较大的修改、补充和完 善，使之更加科学合理，更加有利于解决小额贷款担保难的问题，更加有利于社 会主义市场经济的发展。对解决中小企业和贫困群体融资难的问题发挥重要作 用。但近年来，小额贷款的发展遇到一些困境，中小企业和贫困群体融资困境仍 然是一项世界性的难题，我国也不例外。我国的银行对中小企业和贫困群体普遍 存有较强的“惜贷”心理。作为难以获得正规渠道资金支持的自救办法，中小企 业和贫困群体从“地下钱庄”和“非法民间借贷”规避法律融资的实例大量存在， 并已对我国的金融秩序造成了负面影响。担保制度的规则缺陷成为制约小额贷款 发展的重要因素，在我国国民经济中占据重要位置的中小企业和社会重点关注的 贫困群体，在正规渠道的资金融通上举步维艰、困难重重。完善小额贷款担保制 度的立法，积极发展担保形式多样的小额贷款，对促进小额贷款的可持续发展具 有重要的实践意义。 关键词：小额贷款 担保物权 抵押权 质权 信用担保 Concerning the guarantee system of perfect microcredit LiZhen Summary The guarantee system of property rights is market trading relationship the stable development of an indispensable part of the system, the guarantee system of ancient Roman law have long been by all countries legislation and case seriously, and is constantly perfecting process.
