II II PAGE PAGE 13 河北经贸大学硕士论文  Abst r act The transnational corporations, as the main carrier in the economic globalization, have the scale of production which other enterprises are unable to attain. The development of transnational corporations promote the most superior disposition of resources in the world, provide more opportunities to deepen the trade contact and the cooperation among different countries and zones, and create a closer relationship between various countries. But simultaneously it also means if the transnational corporations are negligent in the guard for the negative environmental influence which they probably create, the harm will also be huge. Moreover the reality has already indicated that development of transnational corporations had already brought the serious ecological environmental contamination, the transnational corporations should undertake the main environmental responsibility of the transboundary pollution in the global scale. In order to prevent confusion arising from the application of law, this article first analyses connotation of the environmental legal liabilities of transnational corporations, then characteristics and theoretical basis thereof, and also defines the meaning thereof. As followed, the article explains the liability-ascertaining principles and the way to undertake responsibility in order to cultivate a further understanding about the environment legal liability of transnational corporations. In the third chapter, the article analyses legal obstacles of environmental legal liabilities of transnational corporations and mainly gives account of the present situation and inadequacies of the international law and the national law. Finally, based on the inadequacies of the international law and national law, the article proposes the corresponding legal countermeasures separately in view of the questions at issue.
