1 1 2 2 摘要 近年来我国经济发展速度快速增长，但在经济快速发展的同时,环境污染和 资源破坏问题也随之凸显出来。解决环境持续恶化和环境犯罪问题必须有法治 作为保障，特别是刑法作为后盾，否则很难有效惩治环境犯罪行为。1997 年《刑 法》的修改和《刑法修正案（八）》的出台，使我国环境刑法有了很大发展。但 是我国环境犯罪刑事立法仍然存在一定的不足，具体表现在：环境刑事立法理 念存在问题、环境犯罪刑事立法保护范围狭窄、环境犯罪构成要件规定模糊等， 这些问题的存在严重制约和影响了环境犯罪的惩治效果。完善我国环境犯罪刑 事立法势在必行。 本论文首先介绍了环境犯罪的基本概况，然后分析了日本,德国,英国,美国 等发达国家环境刑事立法的模式,进而总结出其在环境刑事立法上可以借鉴的 经验,并结合我国具体实际情况,指出我国当前环境犯罪刑事立法中存在的不 足，进而提出我国完善环境犯罪刑事立法中的几点建议。即：应当扩大我国环 境犯罪的立法保护范围，在现有保护基础上增设噪声污染罪等罪名；在完善环 境犯罪刑事立法理念中，坚持可持续发展观；完善环境犯罪的构成要件，增设 危险犯和引入严格责任原则；在完善我国环境犯罪中的刑罚配置上，要加大环 境犯罪的处罚力度，注重环境犯罪中非刑罚措施的适用等。 【关键词】 环境犯罪 环境刑法 环境刑事立法 环境犯罪构成 Abstract In recent years, the development of economic speed of China has increased rapidly, but with the rapid development of the economy at the same time, our environment pollution and resource destruction problems will be highlighted. To solve the problem of environment that continue to worsen and environmental crime, we must have the rule of law as guarantee, especially the criminal law as the basis, otherwise it is difficult to punish environmental crime effectively . In 1997, the criminal law revision and amendment of criminal law (eight) was brought in our country where it set a series of laws and regulations to protect the environment and promote the maturity of environmental criminal law. But there is still a shortage in our country environment criminal legislation. The specific displays are as follows: the problem of environment criminal activity legislation idea, the narrow of environmental protection of criminal legislation and the fuzzy of environmental requirements of the crime, etc. These problems have seriously restricted and influenced the environment crime punish effect. Improving our countrys criminal legislation environment is imperative.
