PAGE 毕 业 论 文 （2016届） 未成年人缔约能力探究 学生姓名 学　　号 院　　系 法学院法律系 专　　业 指导教师 填写日期 PAGE PAGE I 未成年人缔约能力探究 摘　　要 缔约能力指当事人为取得民事权利或承担权利义务，按照自己的意志独立的订立合同的能力。未成年人在社会上作为一类特殊的群体，他们的缔约能力与成年人不同，需要完善好未成年人缔约能力的相关立法，更好的保护未成年人的利益。本文通过列举我国法律中未成年人缔约能力的相关规定，指出无民事行为能力人缔约情形未成年人对合同的追认权、限制民事行为能力人欺诈合同效力、“纯获利益合同”含义不明确这四点立法上存在的缺陷，并从规范无民事行为能力人的缔约效力、规定限制行为能力人利用欺诈手段订立合同的效力、未成年人对合同的追认权、定义“纯获利合同”这四方面，对完善我国未成年人缔约能力提出具体立法建议。 关键词 限制民事行为能力人；无民事行为能力人；未成年人；成年人；缔约能力 PAGE PAGE II Capacity Contracting of Minor inquiry Abstract It refers to the ability of the contracting parties to acquire or assume the rights and obligations of civil rights, the ability to separate according to their own will to enter into a contract.
