摘要 本文起初介绍了惩罚性损害赔偿的基本内容，并总结了该制度的含 义、特点及其所具备的功能。继而分析了该制度在英美法系国家屮的历 史走向和在法律实践中的具体运用情况，同时也分析了该制度在大陆法 系国度中的司法实际和理论研究。 我国FI前的法令屮尽管有对于惩罚性损害赔偿制度的规定，但仍然 是存在许多不足，不能完全顺应我国社会经济发展的需要。本文通过使 用对比分析和历史分析的探究方式，说明了惩罚性损害赔偿制度的适用 前提、使用惩罚性损害赔偿制度的范阖、数额量定等问题，对FI前该制 度的立法近况进行了介绍和剖析，并在总结英美法系国家经验的基础 上，结合我国立法近况，提出了详细建议。 在中国当前有很多部法令和相关司法解释都有关于惩罚性损害赔偿 制度的相关划定，包括保护民事主体的权益、处罚违法行为、限制有关 近似违法行为的再次发生，这些规定都为建立良好的社会秩序起到了重 要作用。然而当前惩罚性损害赔偿制度在我国还存在着不足，在一定程 度上制约了该制度的运用。因此，有必要进一步完善我国的惩罚性损害 赔偿制度。 关键词惩罚性损害补偿抵偿性赔偿民事责任 Abstract This paper at first introduces the basic content of punitive damages, and summarizes the meaning and characteristics of the system and its function has. Then analyzes the historical trend of the system in Anglo-American law system countries and the concrete application situation in legal practice, and also analyzes the system in continental law system country in the judicial practice and theoretical research. Despite in our current law for the regulation of punitive damages system, but they are still many deficiencies, not fully comply with the needs of the development of social economy in our country. In this paper, by using comparative analysis and historical analysis to explore the way and illustrates the application of the punitive damages system premise, use scope, the measure of the amount of punitive damages system, etc., of the current legislation of the system are introduced and analysis, and on the basis of summarizing the experienee in countries of Anglo-American law system, combining with the legislation current situation in our country, puts forward detailed Suggestions.
