论新闻言论仲裁制度在我国的构建.doc

摘 要 早在上个世纪，新闻言论纠纷已频频进入公众视野。随着社会的变迁，新闻 言论侵权的形式、内容不断发生变化。因新闻言论纠纷的特殊性，诉讼、调解在 解决此类纠纷的效果上不是很理想。相比之下，在英国、美国、韩国，新闻言论 纠纷运用仲裁这一纠纷解决方式进行解决的效果显著。更为重要的是，这些国家 通过仲裁解决新闻言论纠纷，不仅使这类纠纷得以彻底解决，而且还促使新闻媒 体业形成行业自律监督规则，达到了遏制新闻媒体行业乱象的目的。事实上，我 国新闻言论纠纷鲜有“光顾”仲裁这一解纷方式。在纠纷解决方式多元化之现实 背景下，完善各种纠纷解决方式，是保障当事人程序处分权的必要举措。通过对 英国、美国、韩国新闻言论仲裁制度的考察，深入分析我国构建新闻言论仲裁制 度的可行性与必要性，在充分利用现有仲裁资源，结合新闻言论侵权纠纷的特殊 性的基础上，提出应效仿上海市仲裁委员会的设置规则，在各市仲裁委员会下设 独立的仲裁庭，合理配置仲裁人员，优化仲裁的申请方式，并借助新闻行业自律 组织的优势，督促其成员配合仲裁等具体建议。 关键词：新闻言论纠纷；仲裁制度；行业自律 I Abstract As early as the last century, the disputes of news comments have repeatedly come into the public eyes. With the change of the society, the form and content of news comments infringement have changed constantly. Because of the particularity of news comments disputes, litigation and mediation is not very ideal in effects on solving these disputes. By contrast, in Britain, the United States and South Korea, using arbitration for solving the disputes on the news comments is remarkable in effects. More importantly, through arbitration, these countries not only thoroughly resolved such disputes on news comments, but also prompted the news media to form industry self-discipline supervision rules, realized the purpose of restraint chaos in the news media industry. In fact, there hardly has the way of dispute resolution in our country for visit arbitration. Under the realistic background of the dispute solution being diversified, perfecting all kinds of dispute settlement methods is the necessary measurement of guaranteeing disposition right for the party. Through the investigation of news comments arbitration system in Britain, the United States and South Korea, the author deeply analyzed the feasibility and necessity of construction of news comments arbitration system in China, on the basis of making full use of existing arbitration resources combining with the particularity of news infringement disputes, it put forward that we should follow the example of the setting up rules in arbitration co
