商务英语合同的语体特征概述--国际商务英语语言与翻译 为了表达的严密性，将众多并列成分纳入一体，平行排列，结构对称随着世界经济和国际贸易的不断发展，我国的经济与世界经济接轨程度不断提高作为我国涉外经济活动的主要交际语言--商务英语发挥了至关重要的桥梁作用因此，商务英语合同翻译的重要性越来越被人们重视商务合同因特 殊的社会功能导致其特殊的文体特点，与普通英语相比，它有其独特的语体特征，文体学为商务英语合同的翻译提供了更为深刻的理论视角，本文将就其词汇、句法等特征作一简单概述, 一.词汇特点 古体词的频繁使用 在商务英语合同中，经常使用一些在其他英语语体中很少或不再使用的古体词出现最多的是由here/there/where+介词构成的古英语，这些古英语常为英文商务合同的文书惯用语比如：hereafter(自此，今后)、hereby(特此，兹)、herein(此中，于此)、hereinafter(在下文中)、hereof(在本文中),学周礼，thereto(另外，随附)、thereof(其中，它的)、whereas(鉴于)、whereby(凭借)、whereupon(因此，于是)翻译这类文书时，也要译成汉语的法律公文体，做到文体的功能对等 例如： The specific contents and procedures of auditing accounts are detailed in Appendix 4hereto(在此). In witness,whereof,the parties hereto have caused this agreement to be executed in duplicate by their duly authorized representations.该句中whereof(关系)副词，连接后面的句子，指parties即签约双方，在句中作状语hereto(在此，至此)作副词，修饰动词have caused. I undersigned hereby certify that the goods to be supplied are produced in Japan.该句中hereby一词为法律常用语，译成兹，符合法律文书的文体要求全句可译为下列签署人兹保证所供应之货物系在日本制造 总的来说，古体词的运用是商务合同写作的一个显著特点，更能体现出法律公文的规范性和约束力而且合同强调用词准确，一般不注意用词的多样化因而同一个次在同一篇、同一段落、甚至在同一个句子中往往会重复多次，而很少用代词或同义词取代，翻译时应遵守用语一致性的原则 2.用词正式 商务合同属于法律文本的一种，因此选词要尽可能的选用正规、庄重或表现力强的法律词语，以显示它的权威性和严肃性比如： Contracts shall be concluded in accordance with the principle of equality and mutual benefit and of achieving agreement through consultation.该句中的in accordance with比according to正式 The obligations shall be affected by the liquidation of the contract nor by apremature termination of the same.此句中的liquidation和termination比其同义词cancel和end都较为正式 一般说来，多数这些词都源于拉丁语，法语和其它语言，试比较以下两组词： Formal(Legal)words Ordinary words construe explain commence begin anticipate expect covenant promise in writing forthwith at once terminate end surrender give certify prove 3.大量使用专业术语 基于商务合同语言的特别，在商务英语合同中经常用到国际商贸实务中相对固定而又常用的词、词组或术语以及缩略语等例如： We have covered the goods against the risk of breakage,TPND,leakage,rust,etc.句中TPND指Theft,Pilferage and Nondelivery(盗窃及不能提货险) Payment will be made by irrevocable L/C at sight against presentation of shipping documents.
