摘要 摘 要 随着现代网络科技的发展以及人们生活节奏的加快,在网络环境的背景下衍生出了 一种新的交易方式——网络购物。当前,网络购物已经逐渐被广大的消费者群体所接受 并且成为了他们日常生活当中的重要组成部分,相比于传统消费,网络消费这种方式对 于消费者而言更加高效便捷,扩大了消费者的选择范围,使得消费者可以全方位的享受 到更为快捷、更为方便的服务。但是随着网络消费的大范围普及,我们也应看到网络环 境下的网络消费面临的新问题,特别是网络消费的过程中消费者权益保护面临的诸多问 题。 文章主要运用案例分析法,实证研究法,法律解释法以及比较分析法对网络环境下 的网络消费者权益产生的问题进行分析,从实践中高发的在网络环境下消费者权益保护 产生的问题入手,首先分析了网络环境下对消费者权益保护区别于传统消费者权益保护 面临的特殊性,并从立法和监管两个方面介绍了我国目前对该领域保护的现状,其次在 借鉴美国、日本等其他国家的相关内容的基础上主要从网络环境下消费者的知情权、自 主选择权及被侵权之后的维权等角度进行探讨,分析了造成我国网络环境下消费者权益 需要加强保护的原因,最后提出针对性的建议,以期促进我国网络环境下的交易市场健 康有序的发展。 关键词 网络交易 消费者 消费者权益保护 - -I 哈尔滨商业大学硕士学位论文 Abstract With the development ofmodern network technology and the acceleration ofpeoples life rhythm, anew transaction method hasbeen derived in the context ofthenetwork environment.
