The existence and abolition of the death penalty system has always been a hot topic. At present, China still chooses to retain the death penalty and limit the application of the death penalty, which is mainly determined according to Chinas socialist national conditions and is a necessary stage for Chinas social development. This article discusses from three parts. The first chapter is the introduction of the death penalty system, mainly from the concept and function of the death penalty system, and the different viewpoints of the death penalty in the academic circle. The second chapter is the current situation of the death penalty system in contemporary China. The basic policy of Chinas death penalty system and Chinas strict restrictions on the application of the death penalty; the third chapter is the reform trend of Chinas death penalty, from the legislative restrictions, judicial restrictions, put forward some of their own views, and the introduction of the abolition of the death penalty is the inevitable trend of Chinas criminal legislation .
