浅谈食品安全的国际规制与法律保障    　　摘要：食品安全问题通常会跨越国界, 并对人类健康产生扩散性影响, 食品安全领域需要更紧密的国际合作及全球治理。从人权法和国际法视角看, 食品安全权概念的提出及其法律保障、遵守广泛接受的国际标准、尊重国际食品安全规范确立的国际义务以及创设国际食品安全规范实施机制, 具有重要意义。在涉及食品安全的规范性国际法律文件中, 《国际卫生条例》等相关规范的软法属性明显, 国际社会应充分发挥并巩固世界卫生组织在国际食品安全规制领域的领导地位, 优化食品安全规制的制度设计, 多渠道创新规制路径以有效应对全球食品安全风险。在作为国际食品安全法律规制基础的食品安全权不断得到认可后, 相关领域国际法律规范的重点在于协调食品安全与贸易自由的冲突, 突出食品安全的优先地位。对中国而言, 当务之急是如何在国内法中贯彻相关国际条约的理念, 减轻不安全食品对食品贸易产生的负面影响, 使中国的食品安全标准与国际安全标准接轨或高于后者, 并得到切实执行。 　　关键词：食品安全,食品安全权,食源性疾病 　　International Regulations and Legal Protection on Food Safety 　　Abstract：Normally, the issues of foodsafety will go over the border and have diffusion effect on human health. Therefore, the fields of food safety need international cooperation and global governance. From the perspective of human right law and international law, the emergence of concept of food safety and relevant legal protection, adhering to international standards, respecting international obligations established by international food safety regulations, and establishing implementation mechanism of international food safety regulations are significant. In the international documents concerning food safety, their characteristics of soft law are obvious, and the international society should consolidate the leading role of the world health organization in the field of international food safety regulations, optimize the system design of food safety system, and create new paths in order to effectively deal with global risks of food safety. Since the right to food safety, as the foundation of international food safety regulations, has constantly gained acceptance, the emphasis of international legal regulations in relevant fields is to coordinate the conflict between food safety and trade freedom and highlight prior status of food safety.
