我国证券市场的法制建设 【摘要】证券市场是所有金融市场中风险最大最需要监管的市场。中国证券市场建立才 十几年所遇到的问题很多，证券市场的监管问题迫切需要我们进行深入的研究提出解决的办 法。本文首先从我国的综合国情和改革开放的历史背景出发，论证了我国证券市场中市场失 灵和监管失灵问题的特殊性和严重性。我国证券市场目前政府监管不力，市场上各方面势力 博弈严重，市场自律也急需加强，已经严重影响了我国证券市场的健康发展。由此论证了我 国政府严格监管和指导证券市场运行的必要性。通过对证券市场不同监管体制的比较，认为 我国证券市场监管新体制的设计只能是在渐进的改革中逐步接近市场管理模式，实行中央、 地方监管与市场自律相结合的监管体制。最后通过分析我国证券市场监管实践，论述了我国 证券市场监管中存在的问题，并针对这些问题提出了相应的对策。 【关键词】证券市场；监管机构；法律制度 Abstract：The securities market is the most dangerous and most regulatory market in all financial markets. Since the establishment of Chinas stock market has been confronted with many problems for more than ten years, the supervision of the stock market urgently needs our in-depth research and solutions. Based on Chinas comprehensive national conditions and the historical background of reform and opening up, this paper demonstrates the particularity and seriousness of market failure and regulatory failure in Chinas stock market. At present, Chinas stock market is not well supervised by the government. The market is playing a serious role in all aspects of the power, and market self-discipline is also urgently needed to be strengthened, which has seriously affected the healthy development of Chinas securities market. This demonstrates the necessity of our government to strictly supervise and guide the operation of the securities market. By comparing the different regulatory systems in the securities market, we believe that the design of the new regulation system in Chinas securities market can only approach the market management mode step by step in the gradual reform, and carry out the supervision system combined with the central and local supervision and market self-discipline.
